In order to advance the membership talks with the European Union, the European Commission proposed, and Moldova committed to a series of measures meant to contribute to the raising of standards in different areas. Following the bilateral screening sessions, that is, the assessment of the compatibility of our legislation with that of the EU, as well as as a result of multiple discussions with representatives of the European Commission, the so-called roadmaps were developed. The Ministry of Justice has the role of coordinator of the process of elaborating and monitoring the implementation of two roadmaps:
The functioning of democratic institutions and the rule of law refers to the fundamental principles of democratic governance: democratic institutions and processes, free and fair elections, transparency in party and electoral campaign financing, an effective and integrity-filled Parliament, a favorable environment for civil society activities, and its active involvement in decision-making processes.
The State of Law includes actions that refer both to Chapter 23 “The Judicial System and Fundamental Rights,” coordinated by the Ministry of Justice, and to Chapter 24 “Justice, Freedom, and Security,” coordinated by the Ministry of Internal Affairs. Chapter 23 focuses on three major dimensions: the judicial system, the fight against corruption, and fundamental rights.
For the judicial system, it is necessary to complete the vetting exercise, appoint judges to the Supreme Court of Justice, operationalize the activities of the selection and evaluation boards, as well as the disciplinary board for judges and prosecutors, improve judicial digital systems, increase the rate of enforcement of court rulings, and enhance the quality of legal training, especially in EU law.Regarding the fight against corruption, measures will focus on aligning the national regulatory framework with European Union standards, strengthening the capacities of institutions with competencies in the prevention and combating of corruption, establishing solid legal protections and support mechanisms for whistleblowers, so that they are encouraged to report acts of corruption.
On the dimension of fundamental rights, measures aimed at strengthening national institutions responsible for the protection of human rights are outlined, ensuring fair and effective criminal procedures, protecting the rights of children, persons with disabilities, and victims of domestic violence. At the same time, actions are indicated that will contribute to improving detention conditions and eradicating ill-treatment in penitentiary institutions, protecting the freedom of assembly and expression, protecting personal data, ensuring equality and combating discrimination, as well as other measures that will ensure that Moldovan citizens enjoy the same rights and freedoms as those in EU member states.
The transposition of all measures from the roadmaps into national legislation and, especially, into practice is essential for the successful culmination of the efforts to integrate the Republic of Moldova into the European Union. It is important to mention that the implementation of these EU rules will significantly contribute to the improvement of the justice system and human rights in the Republic of Moldova.
